I, William Mitchell Day, being of sound mind and memory do make this my last will and testament hereby revoking all others heretofore made by me.

Item 1. If I should die owing any debts it is my will and desire that said debts be paid by my executors as soon after my death as is possible.

Item 2. I give, bequeath and devise unto my wife, Narcisse Elizabeth Day, all of my property of every kind for and during her natural life.

Item 3. Upon the death of my wife it is my will that all of my property of every kind be sold by my executors, either at public or private sale, and the proceeds of same equally divided between all of my children, share and share alike.

Item 4. Some of my children are owing me money and should this money still be owing to me at the time of my death it is my will that each child who may owe me anything that this amount shall be paid by said child to the executors of my estate before he or she shall receive anything from my estate. I do this in order to treat each one alike.

Item 5. If any of my children should be dead at the time he or she is to inherit from my estate and should leave a wife or children then it is my will that his wife or her children shall receive the part that would go to their parent or husband.

Item 6. I appoint my two oldest sons, William Richard Day and Lemuel Martin Day, the executors of my estate and confer upon them full power and authority to administer my estate without making any returns to any court and excuse them from making an appraisement of same and confer upon the full power and authority to sell any or all of my estate, if same should become neccessary, at either private or public sale. It is my intention and I so will that my real estate be kept intact during the life of my wife and not be sold until after her death but my executors with my wife's consent may if they think best dispose of any or all of personal property during her life time.

Obituary:

Mr. William Mitchell Day, age 80, died at his residence near Thomaston Friday morning, Aug. 6th (1943) at 9:00 o'clock after an illness of three weeks. He is survived by his wife, eight sons, Mr. W. R. Day, Mr. W. C. Day, Mr. R. T. Day and Mr. M. E. Day of Thomaston, Ga.; Rev. Lon L. Day and Mr. P. L. Day of Savannah, Ga.; Mr. L. M. Day and Mr. J. L. Day of Atlanta, Ga.; one daughter, Mrs. Mary Lee Treadway of Thomaston, Ga.; also thirty grandchildren and six great grandchildren.

Funeral services were held Sunday afternoon, Aug. 8th at 5:00 o'clock from Atwater Baptist church with Rev. Clifford Bradshaw assisted by Rev. Montague Cook and Rev. C. W. Bailey, officiating. Interment Atwater Cemetery.
